Australia PR Application Rejected? Here’s What to Do!

1024

Well, acquiring permanent residency in Australia is a dream of many individuals, but what happens when your visa application gets rejected?

The door to Australia seems locked, but it actually isn’t. If your visa application is rejected, don’t panic. You still have a chance to fulfill your “living-in-Australia” dream.

There are many reasons why your Australia PR application will not be approved by government authorities, and before applying, it is necessary to check out every possibility of visa application rejection and acceptance.

A rejection is not the end of your Australian journey, but a pause and a chance to improve your visa application and reapply it stronger than before. By understanding the “why”, you can improve your chances in the next attempt.

So, let’s first understand the reasons for the rejection and ways to overcome it!

Why Your Visa Application Rejected?

You will receive a refusal letter from the Department of Home Affairs stating the reasons of your visa application rejection. Some of the common reasons are:

  1. Not meeting the eligibility criteria in terms of age, education, work experience, skills, language proficiency, and more.
  2. Not getting enough points in the PR points system.
  3. Not submitting correct or complete documents.
  4. Failed in Australia’s skill assessment.
  5. Not meeting the character and medical standard of Australia.

What to do Next?

Sitting in disbelief with a rejected visa application in hand is not the solution. You need to knock something out to get your Australia PR visa. Here are the things you can do to immigrate to Australia successfully:

  1. Carefully review the rejection letter and understand the reasons why your visa application is lacking and not up to the criteria.
  2. Compare your visa application with the visa requirements and identify if you met all the criteria or not.
  3. If it’s not understandable, try to seek advice or consultation from an immigration expert. With their knowledge and expertise, you can easily find out the loophole.

Either Appeal Decision or Reapply Application

You will have two options to make your visa application accepted and settle in Australia. Either you can appeal the decision or reapply your visa application by improving it more.

For the former one, you can appeal the decision through the Administrative Appeals Tribunal (AAT). You need to check if your visa allows appeals or if you have applied onshore from within Australia.

If your visa doesn’t allow an appeal, reapply visa application with more improvements. Try identifying gaps and faults and overcome them the next time you apply. Reapplying is like the second chance for you to submit a stronger visa application than before.

How to do It?

Now, how can you file an appeal or improve your application? Here are the results.

To appeal the decision, you need to:

  1. Check the refusal letter for “appeal rights” and “deadlines.”
  2. Submit an appeal with the Administrative Appeals Tribunal within the given time frame.
  3. Gather the additional documents or clarifications to strengthen your Australia PR visa application.

However, it is essential to note that an appeal may take quite a long time, around months, and may involve legal fees.

Additionally, you can improve your visa application by following the below points:

  1. Increase your PR points by gaining more relevant work experience, improving your language skills, try to get state nomination, and more.
  2. Make sure to gather proper documentation. Double check the documents, provide a correct experience letter, and an accurate skill assessment from the authorized organization.
  3. Try to meet the health and character requirements. Consult a healthcare specialist and request a medical waiver or provide additional legal documents or police clearance to meet character requirement.

Explore Australia PR Pathways

If your visa application somehow is not eligible for the same visa category, you can apply under the other visa subclass categories for a better chance.

Below are some of the alternative pathways you can choose:

  1. State-sponsored visa (subclass 190): Some Australian states have lower requirements giving you a high chance to migrate and settle in Australia permanently.
  2. Regional PR visa (subclass 491): This visa category is best suited to live and work in the regional areas of Australia. You can become a permanent resident after acquiring a subclass 491 visa.
  3. Employer-sponsored PR (subclass 186 or 482 to 186 pathway): If you succeed in securing a job offer from an Australian employer, these pathways might be the key to Australia PR.
  4. Partner or Family-sponsored visas: If your close relative or family member is a citizen or permanent resident in Australia, they can sponsor you to live and settle in the country permanently.
